To properly execute an assignment of judgment, you will need the following documents:
A written Assignment of Judgment agreement, signed by the current judgment creditor (assignor). This document must clearly identify all parties involved, including their legal names and addresses, specify the original case number, the names of the original parties, and detail the judgment amount along with any accrued interest, costs, or attorney fees.
The Assignment of Judgment should include a statement confirming any payments or credits made by the debtor to date or a statement indicating no such credits exist.
The signature of the assignor must be notarized or witnessed by two individuals. If the assignor is a corporate entity, the document must be executed by an authorized officer or accompanied by a power of attorney.
A formal notice or certification (such as a praecipe) submitted to the court referencing the relevant case, certifying that a copy of the assignment has been served to the debtor in accordance with court rules.
In some jurisdictions, you may also need to file a certified copy of the original judgment alongside the assignment.
These steps ensure that the assignment is valid and enforceable, allowing the assignee to pursue collection and enforcement of the judgment in their own name. It is advisable to confirm any jurisdiction-specific requirements with the local court or legal counsel to ensure compliance.
